General Terms of Use, Rules, and Legal Responsibilities

The User Agreement, which contains the terms, rules, and legal responsibilities listed below, should be read before using tuaykaraca.com (“Site”). The subject of these Terms of Use (hereinafter referred to as “Agreement”) is to set forth the conditions of membership (henceforth referred to as “User” or “Member”) for benefiting from the tuaykaraca.com website, its portals, and all services within.

If you do not agree with these terms, please do not use tuaykaraca.com. By using the site and filling out the form where your personal information will be included, you accept the terms written on these pages.

All web pages and related pages on tuaykaraca.com are owned and operated by Tuay Karaca Tekstil Özel Tasarım Ltd. Şti. (“Company”). By using the services offered on the site, users agree to be bound by these terms. By continuing to use the site, you confirm that you have the legal authority and capacity to enter into this Agreement, are over 18 years old, have read and understood the Agreement, and agree to its terms.

Terms of Use and Security Rules

Tuaykaraca.com is open to all members. Unless otherwise specified, the services provided on the site are free.

In the following situations, the site management may block the member's access to the site, and legal rights are reserved against those involved in the following actions:

1.a. Registering false, irregular, incomplete, and misleading information, statements that do not comply with general moral rules, or information that is contrary to the laws of the Republic of Turkey.

1.b. Unauthorized copying of all or part of the site content.

1.c. Users are solely responsible for any damages arising from the sharing of their username, password, or similar information with third parties or entities. Users may not use another person’s IP address, email address, username, or access private information of other users without authorization.

1.d. Any activities, software, or actions that could threaten site security or disrupt the functioning of the site and its software.

2. Responsibilities

2.a. The information of users visiting tuaykaraca.com (visit duration, time, viewed pages) may be monitored to improve service.

2.b. Users can start using tuaykaraca.com after completing the required registration fields and confirming their email address.

2.c. Users agree to comply with all applicable laws, including the Turkish Penal Code, Commercial Code, Intellectual and Artistic Works Law, and related legislation while using tuaykaraca.com and its services.

2.d. If it is determined that the User has not fulfilled the obligations set forth in this Agreement, the User’s access to tuaykaraca.com may be temporarily or permanently blocked, and/or the account may be closed.

2.e. Users may not engage in any behavior that prevents or hinders other users’ or visitors' access to tuaykaraca.com.

2.h. Account deletion and membership cancellation can be performed by the User on tuaykaraca.com. The User agrees that this process is irreversible.

2.m. For rules and responsibilities specific to certain sections of the site, please review those sections.

3. Termination of the Agreement

3.a. This Agreement shall remain in effect until the User cancels their membership or the Company terminates it. The Company may terminate this Agreement unilaterally if the User violates any provision of the Agreement.

3.b. The Company may notify the User of a violation of the membership conditions, requesting rectification within 24 hours. If not corrected within this timeframe, the Company may suspend the User’s access to services.

3.c. The Company may suspend access if it believes the User’s actions may negatively impact other customers or the Company’s network.

4. Privacy

The Company is committed to protecting personal information and data security. By using the Site, members agree to act in accordance with these privacy provisions.

The Company shall not use or disclose personal data provided by members for purposes other than those specified in the contract.

In the following cases, the Company may disclose user information:

• When required by legal obligations,
• When necessary to fulfill Company agreements with users,
• Upon request by authorized administrative or judicial authorities.

5. Force Majeure

If obligations arising from the Agreement cannot be fulfilled due to force majeure events, such as natural disasters or wars, neither party shall be held liable.

6. Entirety and Enforceability of the Agreement

If any provision of this Agreement becomes partially or entirely invalid, the remaining provisions shall continue in effect.

7. Changes to the Agreement

The Company reserves the right to change services and terms on the site. Changes will take effect from the date they are published on the site. Users are responsible for following these updates.

8. Evidence Agreement

In any dispute that may arise regarding this Agreement, the Company’s records and documents shall be considered evidence in accordance with the Code of Civil Procedure.

9. Notification Addresses

9.a. The email address provided by the user to tuaykaraca.com shall be considered the official email address for notifications related to this Agreement.

9.c. Notifications sent by tuaykaraca.com to the User’s registered email address shall be considered received one (1) day after being sent.

10. Dispute Resolution and Jurisdiction

The courts and enforcement offices of the Republic of Turkey shall have jurisdiction over any disputes arising from the implementation or interpretation of this Agreement.

By registering as a member, the User accepts all the terms of this Agreement, confirming that they have read and understood them.
