Article 2 - Subject of the Agreement

The subject of this agreement is to establish the rights and obligations of the parties regarding the sale and delivery of the goods/services with the specified qualities and sales price listed in this agreement, ordered electronically by the Buyer from the website tuaykaraca.com. This agreement is prepared in accordance with the Law on Consumer Protection No. 6502 and the Regulation on Distance Contracts. The Buyer declares that they have knowledge of all pre-information regarding the product/service subject to sale, such as essential characteristics, sales price, payment method, and delivery conditions, and that they confirm these electronically before placing an order. The prices listed and announced on the website are sales prices and are valid until updated or changed.

Article 3 - Date of the Agreement

This two-copy agreement, previously signed by the Seller, is accepted by the Buyer on the date of the order, and a copy will be sent to the Buyer’s email address.

Article 4 - Delivery of Goods or Services, Place of Fulfillment, and Method of Delivery

The goods/services will be delivered to the address specified by the Buyer during the order process.

Article 5 - Delivery Costs and Fulfillment

If the Seller has declared that delivery will be free or covered by the Seller for purchases exceeding a specified amount or within a campaign, the delivery cost is borne by the Seller. The Seller delivers the goods/services within 1-7 business days from the order date and reserves the right to extend this period by an additional 10 business days with written notice.

Article 6 - Buyer’s Declarations and Commitments

The Buyer should inspect the outer packaging of the goods/services before accepting delivery, ensuring it is not torn or crushed. Once the undamaged product is delivered, the Buyer is responsible for its care. If the right of withdrawal is to be used, the goods/services should not be used and must be returned with the invoice.

Article 7 - Seller’s Declarations and Commitments

The Seller is responsible for delivering the goods/services in solid, complete, and as-specified condition, along with any user manuals. If the goods/services are to be delivered to another person/organization other than the Buyer, the Seller is not liable if this person/organization refuses delivery.

Article 8 - Characteristics of Goods or Services Subject to the Agreement

The type, quantity, brand/model, color, and total sales price (including all taxes) of the goods/services are as stated on the product/service promotion page on the website tuaykaraca.com and in the invoice, which is considered an integral part of this agreement.

Article 9 - Cash Price of Goods or Services

The cash price of the goods/services is available in the example invoice sent by email after the order and in the invoice sent with the product.

Article 10 - Installment Price

The installment price based on the sales price of the goods/services is detailed in the invoice sent by email after the order and in the invoice sent with the product.

Article 11 - Payment Plan

If the Buyer makes a purchase with a credit card and in installments, the installment type chosen on the site applies. The terms of the agreement between the Buyer and the bank are valid for installment payments.

Article 12 - Return and Exchange Conditions, Right of Withdrawal

In cases such as an incorrect product or damaged packaging caused by the Seller or the logistics firm, the Buyer may contact Customer Service at 0212 858 1920 to request a replacement. The Seller will send a new product if available. The Buyer may exercise the right of withdrawal within 14 days from the delivery date, provided the goods/services have not been used and that they notify Customer Service by phone within this period.

Article 13 - Order Cancellation

The Buyer may cancel the order anytime after placing it and before the product is handed over to the shipping company. If the product has already been shipped, the cancellation request cannot be fulfilled; however, the Buyer may request a return following the return conditions.

Article 14 - Authorized Court

In case of disputes arising from this agreement, the Consumer Arbitration Committees, the Consumer Courts for amounts above the threshold, or, if unavailable, the Civil Courts of First Instance are authorized.
